LEAD THE FIELD – COACHING AGREEMENT

This Service Contract for Programme facilitation (“Agreement”) by and between The Infinite Mind CompanyLTD (“Company”) and the undersigned (“Client”). The following agreement will apply once you subscribe to the programme:

Agreement

• • 4 month Programme facilitation of ‘Lead The Field’. Delivered in 12 lessons, to ensure that the methods and the creation of a success mindset becomes part of each participants thinking. Actions and results can translate into an exceptional return on investment providing you follow the recommendations set out in clause 4 below.
  • The Infinite Mind Co. promises that all information provided by the CLIENT will be kept strictly confidential.
  • The CLIENT understands that facilitation of the programme is not psychotherapy or counselling and is not a substitute for professional counselling by a licensed psychotherapist or other licensed professional. The client understands that Company does not consist of any licensed psychotherapists or counsellors.
  • The Client also understands and agrees that the Company’s services are not specific financial advice and as set forth the Company cannot guarantee a financial success. The client acknowledges that the Company are not financialadvisors, and that Company shall not provide financial advising services that require any licensing on a state or federal level.
  • The Client also understands and agrees that the Company’s services shall not be construed to be legal advice. The Company does not provide legal advice or legal services.
  • Whilst the Company will strive to assist clients with the highest and best level of services as provided in the scope of the agreementThe CLIENT enters into the programme with the understanding that they are responsible for creating their own results.The client understands that with any programme, the Company is unable to make promises or guarantees with respect to any outcome from participation in the programme and therefore the Company does not guarantee success, or any specific level of income or results associated with the services provided. The client further understands that ultimately it is the responsibility of theclient for his or her success and that this programme is designed to enhance, supplement, and support the client in his or her efforts.

The limitations listed in this section are not an exhaustive list and not meant to be a comprehensive list of all limitations.

• The Company offers a no refund policy for this Programme. Once the Client subscribes to the programme they fully understand and comply with the agreement and the no refund policy. Should the Client breach the contract or fail to keep up with payments, the client shall still remain liable for the full programme amount.

Services

• The service provided to the CLIENT by The Infinite Mind co. is the 4 monthfacilitation of the ‘Lead the Field’programme.
• The ‘Lead the Field’ programme Includes:
  • Online digital access to the LTF Programme by Proctor Gallagher Institute, including downloadable workbook
  • 12 lessons delivered by experienced instructors – acclaimed teacher, Bob Proctor, Proctor Gallagher Institute President and CEO, Sandy Gallagher.
  • Weekly access to 2 live open group Q&A sessions
  • Access to private client only Facebook group for support
  • Access to mastermind groups and supportive client community
  • Monthly newsletter
  • Full backup support from ‘The Infinite Mind Company’ team
• The Client understands and agrees that the schedule for weekly session calls is subject to change with or without notice to the client and shall be set forth by the Company. The coaches assigned to the calls mayvary based on the discretion of the Company.
• Participation in the Facebook Group. The client understands that participation in the Facebook group created for theprogramme facilitation and client supportis subject to the terms and conditions set forth by Facebook. The client understands that the company is in no way affiliated with Facebook or its affiliates and therefore, the client agrees to hold the company harmless from any action or inaction taken by Facebook. Nothing in this Agreement shall be construed to benefit Facebook or any other third-party entity or individual in accordance with this contract.
• If the Client breaches the contract or includes improper use of the Facebook group and any materials provided, the Company reserves the right to immediately remove the Client from the Facebook Group and cease access to all programme materials and login details. If the Company elects to terminate this agreement due to the Client’s breach of the Agreement, failure to adhere to the Terms & Conditions, and/or for misuse of the programme materials, the Client shall remain responsible for payment for the services for the full 4 month term.

Fees and Payment

• The applicable fee for the Programme must be paid in full and collected prior to the beginning of the facilitation of the programme, or as agreed via 4 equal monthly instalments. Approval and set up of monthly payments does not convert the programme to a month to month programmeand the Client understands and agrees that the amount due and payable is the total amount for the programme. The Client agrees that if paying in instalments, payment shall be taken automatically via our payment system with the details you provided when setting up and processing your first payment.
• The Company offers a no refund policy for this Programme.If the Client attempts to terminate the agreement during the 4 month term or if the Client elects to stop utilising the available contracted services during the 4 month term the Client’s obligation to pay for the full purchase price for the 4 month term shall remain.
• All funds will be deemed earned by The Infinite Mind Co. as soon as they are received. This includes all monies outstanding and not paid up front. These will be deemed owed regardless.
• Once payment is received your access to the online programme will be set up to enable you to login. Your login access can be terminated without any warning if you fail to make your contractual payments and/or the company suspect that there is misuse of materials and data, i.e. sharing with third parties.

Recommendations

• For successful completion of the programme, we recommend that you follow the steps outlined below. The CLIENT must however remember that they are still subjected to clause 1.3and 1.6, should they not get the expected results.
• Be honest with yourself and participate fully. Recognise that sessions are a safe place to look at what you really want, and what it will take to make it happen.
• Make a commitment to completing all your assignments and to complete the action plans you create, ensuring that you deliveron what was set out or agreed to do.

Confidentiality

• During the term of this Agreement and thereafter, the Client shall not use or disclose any of the Company’s Confidential Information or programme methods. The client agrees that the confidential information is proprietary exclusive to The Infinite Mind Company. As used in this Agreement, the term “Confidential Information” shall mean all technical, operational, and economic information relating to the services and training performed or the business of the Company, its employees, contractors, subsidiaries and/or affiliates, that is designated or treated as confidential by the Company, including, without limitation, all technical, or nontechnical data provided to the Customer, all manuals, programmes, and methods of the Company and all content hosted on the site. The client acknowledges that the programme and materials are created solely by the Company and is and will remain the sole property of the Company. The client understands and agrees that use of the site is limited to the client and that the client shall not grant access, of their log-in information to any third parties. The Customer agrees not to repurpose or distribute any written materials provided through the course of the programme to any third-party. The client understands and agrees that violation of this provision shall be a breach of this agreement and that the client shall immediately lose access to the site, the Facebook Group, and all other services provide by the programme if this provision is breached. The client understands that breach of this provision and resulting in removal from the programme does not remove the client’s obligation to pay for the entire 4 month term. The client understands, acknowledges, and agrees, that any remedies set forth in this section shall not limit any other remedies afforded to the company through law or equity.

The parties hereby agree to the termsset forth herein.
